These terms and conditions represent the whole agreement and understanding between Flow Functional Health Care Inc. and the individual or entity who subscribes to our service or website (“Member(s)”, “Patients", “Clients” or “you”).  Flow Functional Health Care Inc. may in its sole discretion, change or modify this agreement at any time with or without notice. All modifications shall be made effective for all members upon posting of the modified agreement to this website or services. You are responsible to read this document from time to time to ensure that your use of the service remains in compliance with this agreement.

You agree to indemnify, defend and hold us and our suppliers harmless from and against all claims, damages and expenses arising out of or related to your use of this site, except to the extent permitted by applicable law.

Governing Law

These terms are governed by the laws of the Province of Alberta. You consent to the exclusive jurisdiction and venue of courts in Alberta in all disputes arising out of or relating to the use of this site. Any cause of action or claim you may have with respect to Flow Functional Health Care Inc. or its suppliers must be commenced within two (2) years after the claim or cause of action arises. Neither our nor your failure to enforce strict performance of any provision of these Terms shall be construed as a waiver of any provision or right. We may assign our rights and duties to any party at any time without notice to you, and may provide services to you through our business partners and suppliers.

Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of our obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of this site or information provided to or gathered by us with respect to such use. If any part of these Terms is determined to be invalid or unenforceable then the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms shall continue in effect.  You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Province of Alberta for any dispute arising under or relating to this agreement and waive your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under this agreement in any jurisdiction where you reside, do business or have assets.

No Warranties; Limitation of Liability

You are responsible for any acts or omissions relating to your use of this website and for any damages incurred as a result thereof. We reserve the right to delete, modify or add any element, documentation, picture, or content within our website. It is the members’ sole responsibility to confirm the information is up to date and accurate as any notification obligation is not required on our behalf.
